EU Commission finds Apple and Meta in breach of the Digital Markets Act (DMA).

The commentary
The European Commission found that Apple breached its anti-steering obligation under the DMA, and that Meta breached the DMA obligation to give consumers the choice of a service that uses less of their personal data. Therefore, the Commission has fined Apple and Meta with €500 million and €200 million respectively. The two decisions come after extensive dialogue with the companies concerned allowing them to present in detail their views and arguments.
These fines are part of the EU’s broader strategy to enforce the DMA and prevent large tech companies from monopolizing digital markets. While the penalties are significantly lower than the potential maximum fines of up to 10% of global turnover, they reflect the Commission’s cautious approach amid ongoing trade negotiations.
Both Apple and Meta have criticized the decisions, alleging unfair treatment and discriminatory enforcement. The Commission will reassess the companies’ compliance in two months, leaving open the possibility of further penalties.
