The commentary

The US Supreme Court has not yet issued a ruling on the legality of President Trump’s broad tariff program. A highly anticipated opinion that could either affirm or overturn lower-court findings has not been published this month so far. The Court entered a four-week recess, suggesting that the next likely timeframe for a tariff opinion may be expected by late February 2026 under its usual schedule.

In 2025, the US Court of International Trade determined that the tariffs imposed under the International Emergency Economic Powers Act (IEEPA) exceeded the authority Congress granted the president and were thus unlawful. The US Court of Appeals for the Federal Circuit affirmed that the tariffs were “invalid as contrary to law.” However, the appeals court stayed its mandate while the Supreme Court reviews the case, leaving the tariffs in effect for the time being.
