The case

Documents related to the financing of political activities are, in general, subject to the freedom of information principle under Swiss law.

The commentary

The Federal Administrative Court (BVGer) concluded that the Federal Act on the Freedom of Information Principle (BGÖ) remains applicable even in the context of the new transparency regulations on political financing.

Despite this, the Swiss Federal Audit Office (SFAO) left the option open whether other grounds for exception might apply to the disclosure of the relevant documents, such as the protection of third-party privacy. For this reason, the Court referred the matter back to the SFAO for further examination and explanation.

The judgments may be appealed to the Federal Supreme Court.
